Actually this fight has been going on for years. State and local government do make laws controling our water ways but those laws are illegal. Those laws have all been over turned when actually taken to court. Win or lose on this subject the state and local governments come right back claiming the same thing. Bottem line is the state and local government can not control asscess to our water ways.

States do have the sovereign power to protect the waterways and ensure the publics right to access and enjoy the waterways for perpetuity. The river bed itself only belongs to a state if the waterway or river above it was not navigable at the time of statehood.

Doc, you're confused. Since 1947, waterways within NC are policed by the Wildlife Resources Commission, unless otherwise designated:

Wildlife officers have the same ability to board your boat for any reason, just like the Coast Guard. And all NC laws still apply.
Missouri state law specifically allows gambling on licensed boats, so that has nothing to do with loopholes in federal law:

Wilkes should become the premiere testing center for deep brain stimulation in the treatment of meth and crack cocaine addiction. Once the electrodes are implanted and the trials proven success rate exceeds suboxone's people from all over the world would come here for treatment. We may even need a nuclear reactor power station built to stimulate all those brains.

You see, techn the river is not in Wilkes or NC. The only laws that apply while on the river is federal laws. I know, the cops amoung and maybe some lawyers will disgree but in fact, I am correct.

Not really. you see the river is not under local or state laws. The laws that rule the river are meritime laws. That means the same laws on ocean going ships apply.

That is how they have gambling in Miss. Gambling is illegal in Miss but you can still go there and gamble. However, you will notice the casinos are floating on water.

It has to do with free trade. The rivers are historicly pathways for trade. The Constitution says no state or local government can pass laws restricting trade.

By the way, those ****s at the dam who have restricted achol can only restrict it on the land, not on the water. I know they try to do it but it is not legal for them to do so. Only the coast guard could enforce a law like that on a river in America.

The point is it is not gambling. It is just a game. Like in any arcade. You play for tickets and then you trade your tickets for items.

I didn't write the law, I'm just telling you want it says. The law says that gambling with anything of value is illegal, and a chip worth X amount of dollars would fit that description.
Even if it didn't, the laws on raffles clearly state that a game with a prize at the end is illegal, unless you meet specific criteria.
You're welcome to try, and I wish you the best of luck! But from what I'm reading in the law, it wouldn't fly.
